<strong>FROM THE PRESIDENT'S DESK</strong> 
<p>Happy New Year to all of you! I hope that your holidays were everything you wished for, and more! 
<p>I am very excited to have begun my term of office as your President. It is my hope that I will be able to serve you well in the year ahead. 
<p>Last year, the theme for our annual REALTOR® Celebration was “Rock Solid Throughout the Years.” I have chosen to adopt this theme for 2012 because I believe it truly illustrates where we have been, where we are, and where we hope to be in our future. We have all had a difficult time, but we have remained steadfast in our business and have continued to prepare ourselves for what lies ahead with nothing but hope and the continuation of our dreams in our hearts and minds. Our Association will&nbsp;stand beside you as we all&nbsp;push ahead and push through the challenges that we continue to face as our business recovers.&nbsp; Antoine de Saint-Exupery said "a rock pile ceases to be a rock pile the moment a single man contemplates it, bearing within him the image of a cathedral."&nbsp; What our industry has given us, fellow REALTORS, is a rather large rock pile that needs to be reshaped into something better than it was before.&nbsp; It is the image of "what could be" within all of us that CAN make that happen. 
<p>So far this year, your leadership has met to explore the possibilities that 2012 has to offer. We are excited about the upcoming Pancake Breakfast and Golf Tournament of the Scholarship Foundation. The Pancake Breakfast will be Saturday, February 11th (details follow in this newsletter) and the Golf Tournament has been scheduled for the month of April (details will arrive as we near this event). The first General Membership Meeting of 2012 will be held on March 7th at our association office. Details about this event will be made available at a later time, as well. We are still in the planning stages of the new year, so we are not certain of all of the things in store for us in the months to come! 
<p>I am very honored to have been selected to conduct this role and to serve as one of the representatives of your voice as a member of SMTAR. Please feel free to contact me if the need arises, and I wish you all the very best of 2012.

<strong>SMTAR SCHOLARSHIP FOUNDATION PANCAKE BREAKFAST</strong>&nbsp; 
<p>Celebrate Valentine's Day with us this year!&nbsp; The SMTAR Scholarship Foundation, in conjunction with Applebee's of Columbia, will host a <a href="http://www.southernmiddletennessee.com/scholarship/iwantpancakes.htm">Pancake Breakfast </a>to raise money to support the 2012 Scholarship Awards.&nbsp; This event is open to the public, and we invite you to bring your friends and family.</p>

SENTRICARD BILLING UNDERWAY&nbsp; 
<p></strong>
<p>RealTracs has advised us that the annual Sentricard User Fee invoices will be posted to your RealTracs account on Wednesday, February 1st.&nbsp; Please be aware of the following information regarding these invoices:</p>
<ul>
<li>Payments are DUE on March 1st. 
<li>When you log in to RealTracs, a message will alert you that your invoice is available.&nbsp; You will have the option to pay the invoice immediately or ask the system to remind you later.&nbsp; Should you choose the option to be reminded later, the system will not alert you again until February 15th, or the first time you log in after February 15th. 
<li>Failure to pay by the due date will result in termination of your Sentricard.&nbsp; There are no late penalties or reinstatement fees - you simply lose this service until you pay. 
<li>RealTracs has advised us that they are now required to charge sales tax on this service.&nbsp; This will bring the total due on your Sentricard to $131.16 (for REALTORS only.) RealTracs has not<br>provided the information on the exact cost for our Affiliate members who hold Sentricards.</li></li></li></li></ul>

<strong>FROM THE PRESIDENT'S DESK</strong> 
<p>I hope everyone had a Merry Christmas and made it to and from their destination safely.&nbsp; This is my closing letter as President of SMTAR.</p>
<p>First of all, I would like to thank the Board of Directors this year for the service they have provided our association throughout the year.&nbsp; Also, thanks&nbsp;to Rebecca Head for her hard work this year in the office, with the newsletters, and all service she provides our members each and every day. We had to make a tough decision when working with our budget this year to cut our staff resources.&nbsp; As a result, Tammy Brown will not be with our Assoiciation as we begin 2012.&nbsp;&nbsp;Tammy, thank you for your hard work keeping up the lockbox system and supporting Mary and Rebecca. You will be missed. To Mary Scott, &nbsp;thanks for always making sure I know where to be and when. Thank you for all the support you have given me throughout the year</p>
<p>This year, business&nbsp;at the association has been more-than-likely similar to the struggles your company has faced with the economy. The purse&nbsp;strings have been pulled tight and you have been trying to squeeze every penny out to make your budgets work! Hopefully, in 2012, things will improve with the real estate market and more sales will take place.</p>
<p>To everyone that might have lost a friend or a family member during 2011, you will continue to be in our prayers as you continue the healing process. To our incoming President Melissa Potts, Good Luck and I look forward to serving with you in the upcoming year! To all of our Members of SMTAR, I’m wishing you &amp; your family a Happy and Prosperous New Year! Thank you for reading and see you soon on the Real Estate Road. Now Go Sell Something!</p>

<p>Members have advised SMTAR staff that a new SCAM is afoot.&nbsp; Members are receiving an e-mail that appears to be from the Better Business Bureau regarding a complaint against them.&nbsp; This e-mail is a whopping fake and includes a potential virus risk.&nbsp; Do not click the link in the&nbsp;e-mail should you receive it.&nbsp; More information regarding this SCAM is available at the <a href="http://www.bbb.org/us/article/alert-scam-email-claims-its-from-bbb-30916">Better Business Bureau Website.</a></p>

<strong>FROM THE PRESIDENT'S DESK</strong> 
<p>I hope everyone had a very Happy Thanksgiving and that you all are looking forward to the remainder of the holiday season.&nbsp; Word on the street is that my fellow REALTORS have been working hard, and this is great news!&nbsp; We have our fingers crossed that 2012 will be a great year for our business.</p>
<p>I am pleased to report that the annual REALTOR Celebration was a success despite the low number of reservations.&nbsp; This was an extra-special event this time as it was the kick-off to our 50th Anniversary, which will occur on May 8th of 2012.&nbsp; The theme for this year's celebration was "Rock Solid Throughout the Years."&nbsp; In an effort to depict this theme, the Social Committee requested that photos of our Association's past be prepared and presented to those attending the event.&nbsp; The result was several boards with photos and a slideshow presentation that contained over 700 pictures.&nbsp; It was really great to remember the road we've travelled and the people that have been a part of our REALTOR family.&nbsp; I'd like to thank the Social Committee for their work on this event.&nbsp; As always, it was a special evening.&nbsp; (By the way, if you would like to purchase a copy of the slideshow, a link to the order form&nbsp;will be provided later in this newsletter.)</p>
<p>I would also like to extend my thanks to those who donated funds to support the event.&nbsp; Without this group of people, it would not have been possible.</p><td><tr>

<p>Another committee that was a part of this night's festivities was the Awards Committee.&nbsp; This committee was responsible for selecting the award winners from those nominated and are please to present the following award winners:</p>

<p>I would like to wrap up this month's newsletter with my final report from our annual REALTOR Celebration.&nbsp; As you all know, in June of this year a member of our Board of Directors lost her&nbsp;daughter in an auto accident that claimed the life of another child and injured two others who were in the same vehicle.&nbsp; This loss has affected me, and other members of our Board in a way that we could not have imagined.&nbsp; We (the SMTAR Board of Directors and the Scholarship Foundation Board of Directors) felt that we should find a way to remember this young lady's life and to find a way to let her mother know that we care.&nbsp; The Sarah Graham Memorial Scholarship&nbsp;Award&nbsp;has been established to honor the memory of this young person, who would have been graduating in 2012.&nbsp; This scholarship will be presented each year to a student graduating from Summertown High School.&nbsp; It is our hope that this will be a way for the memories of Sarah to carry on for years to come and that her mother, Jennifer Graham, will find that her own grief will fade as time passes so that only those cherished memories will remain to fill her heart.</p>

<strong>TIME TO PAY YOUR DUES (AND OTHER NOTICES)</strong> 
<ul>
<li>Your favorite time of year has arrived!&nbsp; Well, we're kidding about that - it's not our favorite time, either.&nbsp; Dues invoices for 2012 are scheduled to pop into your e-mail boxes toward the end of the week.&nbsp; They will be due on January 1st, and primary members will pay $470.&nbsp; This amount reflects a $5 increase from TAR and a $40 increase from NAR.&nbsp; Members who pay by December 31st may deduct a $10 discount from their payment. 
<li>The SMTAR office will be CLOSED on the following dates for the holidays:

<strong>SIGN ORDINANCE</strong> 
<p>It has come to our attention that parts of the sign ordinance in the City of Columbia have changed since our last review of the ordinace a few years ago.&nbsp; For those of you who list properties within the city limits of Columbia, please take a moment to review <a href="http://www.columbiatn.com/PDFs/Zoning%20Ord%2010-11-11.pdf">Article 15</a> of the city's zoning rules.&nbsp; The most notable change is the dimensions of signs that are permitted on large tracts of property for sale (over 10 acres.)</p>
<p>We also recommend that you take the time to review sign requirements in the area that you normally do business.&nbsp; We know that your real estate signs can be very expensive.&nbsp; Violation of a locality's sign policies could result in removal of your sign and possible fines in some areas.&nbsp; As you are researching, it is important to remember that a city's ordinance may be different than the ordinance for the county.&nbsp; The links below will help you get started:</p>

<p>We were unable to locate web links for the counties of our jurisdiction regarding sign placement and usage.&nbsp; We were also unable to locate information for several cities in our area.&nbsp; In some cases, links indicated that information might be available, but the direct link to that information on the web did not function.&nbsp; A simple web search for the city or county involved, however, should refer you to a phone number to contact for additional information.&nbsp; Here are a few good rules of thumb when placing signs:</p>
<ul>
<li>In many cities, signs, including pointer signs placed and the end of a road or street,&nbsp;are required to be placed on private property and not in the city's right of way.&nbsp; The Columbia Police department has advised us that the city's right of way in this city extends to just past utility poles or 5 feet from the road surface.&nbsp; Be sure to obtain permission from the property owner before placing any sign on private property.&nbsp; 
<li>Generally, signs should not obstruct the view or be hazardous to those travelling along the roadway. 
<li>If you are placing a sign larger than a standard real estate yard sign (24" x 24"), it is a good idea to verify the ordinance pertaining to that property before placing the sign.&nbsp; We have received some complaints that expensive signs had to be removed because they did not conform to the dimensions specified in the applicaple zoning ordinance.</li></li></li></ul>

<p>I hope everyone has had a great October!&nbsp; SMTAR is getting ready to celebrate your accomplishments for 2011, and we are looking forward to installing our Officers and Directors for 2012 at the annual REALTOR Celebration on November 19th.&nbsp; The Awards Committee has just met and made their selections for this year's special awards.&nbsp; If you'd like to know whether or not you were selected for an award, please be sure to buy your ticket for this event this week.&nbsp; If you're just curious about who won the awards, join us to find out first-hand!</p>
<p>I just want to let everyone know that the National Association of REALTORS is still fighting to keep the Mortgage Interest Deduction in place.&nbsp; This may be a long battle, but it is one that we hope will result in your voice being heard.</p>
<p>At this time, much of our attention has shifted to preparing the Association for the new year and wrapping up the loose ends from 2011.&nbsp; I'll see you next month with new from the REALTOR Celebration!</p>

<strong>ANNUAL MEMBERSHIP DUES</strong> 
<p>It is time, once again, for the association to prepare for the annual billing of your membership dues.&nbsp; Our Finance Committee and Board of Directors has not yet finalized the Local Dues for our association.&nbsp; We will bring this information to you as soon as we are aware of the pricing.&nbsp; Please remember that you may prepay your dues at any time between now and the bill date.&nbsp; You annual dues are required to be paid in full by January 1, 2012.&nbsp; We do prefer that you make any payments in, at least, $50 increments.&nbsp; As a reminder, members who do not pay their dues by January 15th will be deleted from membership and an invoice for their dues will be sent to their principle broker.</p>
<p>SMTAR staff are currently evaluating an e-Commerce dues billing solution offered by the National Association of REALTORS.&nbsp; In the weeks ahead, we will determine if dues invoices will be sent out from this service, or if we will send the invoices via our in-house invoicing system.&nbsp; You will be notified by e-mail of what to expect when the decision is made.&nbsp; In the event that we send invoices using the new e-Commerce solution, we will need an updated e-mail address for you in the National REALTOR Database.&nbsp; <strong>Please take a moment to ensure the e-mail address on file in NRDS is correct.&nbsp; The instructions for doing this are below:</strong></p>

<p>I am very excited to announce that it is almost time for our annual REALTOR Celebration!!&nbsp; This will be the 33rd annual event, and we are going to prove that we are "ROCK SOLID Throughout the Years."&nbsp; The Social Committee has been working on some very special things for this event.&nbsp; This year, the Celebration will also be the kickoff to SMTAR's 50th Anniversary that is coming up next year.&nbsp; What a great accomplishment!&nbsp; The Celebration will be held Saturday, November 19th at the UAW Banquet Hall in Spring Hill and tickets are on sale now for $35 each.&nbsp; Be sure to reserve your seat for this great event, where we will install the 2012 Board of Directors and present our special awards.</p>
<p>Each year, SMTAR REALTORS are acknowledged for their service to SMTAR at the REALTOR Celebration.&nbsp; We have just made the call for nominations for our special awards, so don't forget to submit nominations by October 13th.&nbsp; Here is a list of the awards and what they are all about:</p>
<ul>
<li>The <strong>REALTOR of the Year </strong>is selected based on REALTOR spirit (30%); business accomplishments (30%); service to the local and/or state associations (25%); and&nbsp;their service to their community (15%).&nbsp; Please note that this award is NOT based on sales volume. 
<li>The <strong>Andy Akin Distinguished Service Award</strong> is presented in recognition of dedicated service and outstanding contributions to our Board of REALTORS.&nbsp; The nominee should be someone who upholds the Code of Ethics, shows integrity, has a good working knowledge of real estate, is cooperative with others and always displays a professional image. 
<li>The <strong>Student of the Year</strong> is presented to the member who has accumulated the most real estate related educational hours between September 15th, 2010 and September 15, 2011.&nbsp; For this award, only nominations from the nominee's Principle Broker are considered, and the hours must be verifiable. 
<li>The <strong>Pioneer Award</strong> is given to someone who shows true leadership quality and helps to pave the way for all members to enjoy success in our profession.&nbsp; This award is not annual and is given at the discretion of the Awards Committee. 
<li>The <strong>Career Achievement Award</strong> is given in recognition of superior achievement in real estate.&nbsp; This award is not annual and is given at the discretion of the Awards Committee. 
<li>Be sure to send your nominations in on time!&nbsp; Don't let your deserving collegues go unnoticed!</li></li></li></li></li></li></ul>
<p>Special congratulations are in order for SMTAR member, Steve Hill with Re/Max Pros of Lawrenceburg.&nbsp; Steve was just awarded the GRI Student of the Year award at the TAR&nbsp;Convention in Savannah.</p>
<p>Before I go, I'd like to say a quick "Thank You" to all of those who became an RPAC 99'er this year.&nbsp; We did not win the RPAC trophy for our Association size, but we placed well and met our RPAC Fair Share Goal for 2011.</p>

<p>Based on low numbers at the recent TAR Convention in Savannah, we know that most of you missed out on some great information.&nbsp; Our Association Executive, Mary Scott, would like to share some great FREE tools with you that she learned of at the convention:</p>

<li>Have trouble keeping your electronic files available wherever you go?&nbsp; Consider Dropbox.&nbsp; More information can be found at <a href="http://www.dropbox.com">http://www.DropBox.com</a>. 
<li>Need to remind yourself to do something later?&nbsp; Would you like to send yourself a text message as a reminder?&nbsp; Consider these options: 
<ul>
<li><a href="http://calendar.google.com">Google Calendar</a>&nbsp;- Google Calendar is a great way to keep up with your appointments.&nbsp; You can set up reminders to be sent by e-mail or by text to your cell phone, and your calendar can be shared. 
<li><a href="http://www.ohdontforget.com">OhDontForget.com</a>&nbsp;- This free tool lets you quickly type in a text to be sent at a later time.&nbsp; It is a great way to remind yourself, or someone else, about something important.&nbsp; The free service contains ads for the OhDontForget website, but a lot more features (such as recurring appointments) can be purchased for just $4.95 a month.</li></li></ul>
<li>Speaking of Google, you can also share documents with others, or create new documents using <a href="http://docs.google.com">Google Docs</a>. 
<li>Do you always seem to get pictures from clients or vendors in some format that you are unable to open (such as .png or .gif)?&nbsp; Convert it!&nbsp; <a href="http://www.rsizr.com">http://www.rsizr.com</a>&nbsp;will allow you to open an image and convert it to a .jpg file with ease. PLUS, you can crop and resize the photo! 
<li>Need to hold an online meeting, but don't want to spend the green stuff?&nbsp; Try <a href="http://www.anymeeting.com">www.AnyMeeting.com</a>!&nbsp; This free service allows you to meet with up to 200 attendees and has tons of features to help you conduct a professional meeting.</li></li></li></li></li></ul>

<strong>HOMEBUYERS ARE CHANGING.&nbsp; ARE YOU?</strong>
<p>NAR's recent publication of "Global Perspectives," a newsletter that takes a deeper look into the global real estate market and lifestyle, highlighted some interesting statistics regarding today's homebuyer.&nbsp; According to the 2010 U.S. Census, minority populations are growing at a much-faster rate than the general population.&nbsp; This population growth, combined with other interesting statistics regarding income and age of those minority groups, might indicate that the face of the average homebuyer will include a greater mix of ethnicity than it has in the past.&nbsp; Of particular interest are the increases in the Asian and Hispanic populations throughout the U.S.&nbsp; What does this mean for you?&nbsp; Well, with a greater mix of ethnicity, licensees will need to expand their working knowledge of how the various cultures work.&nbsp; Right now, the majority of real estate agents in the U.S. deal predominantly with American buyers.&nbsp; While there is a great mix of culture within our own country, many of those have adopted the traditional, American way of life.&nbsp; Because of this, little difference may be noticed from one buyer to the next when it comes to housing.&nbsp; However, many families, from other countries,&nbsp;that now live in the U.S. are still deeply connected with the way of life of their culture.&nbsp; These groups may have very different requirements for homes than the average American.&nbsp; According to the "Global Perspectives," Asian and Hispanic families often house several generations within their home.&nbsp; Additionally, some families' religious beliefs may play a factor in which home they consider for purchase.&nbsp; The true challenge that REALTORS across the nation face is to be able to anticipate and respectfully honor homebuying traditions of their cultural clients, while at the same time following Fair Housing Laws and providing equal service to all groups.&nbsp; This all boils down to taking the time to understand the actual needs of your clients before you begin suggesting properties to them.&nbsp; </p>
<p>You may be interested to know that the growth rate of various ethnicities&nbsp;in the Southern Middle Tennessee area is much slower than the rate of the nation.&nbsp; This does not mean that things are not changing.&nbsp; As the perspectives of&nbsp;homeowners of the nation change, so does the way the&nbsp;real estate industry works.&nbsp; To stay on top of things, it is important to remember that it is the homeowner that drives our business.&nbsp; We must adapt to their needs rather than have them adapt to ours.</p>

<strong>CARRYOVER CLAUSES CAUSING PAUSES</strong>
<p>If you are taking on a listing that was previously listed with another company, it would be a good idea to have your seller review their previous listing contract to see if a carryover clause was included.&nbsp; A carryover clause provides that the brokering company is still entitled to a commission if the property is sold after expiration.&nbsp; Usually, the clause indicates a specific amount of time, and will state that the commission is applicable if the property is sold to a prospect of the original broker.&nbsp; However, it is important to remember that real estate contracts may vary from company to company and that each contract should be treated as unique.&nbsp; The carryover clause is often missed by sellers who are then surprised to learn that they may owe a commission, even if they have changed listing agents and their listing contract with a previous company has expired.</p>
<p>Not only should you encourage sellers to review their&nbsp;listing contracts with previous companies, but you should also ensure that you are explaining the carryover clause to all those who list properties with you.</p>

<p>Well, the month of August has come and gone, and I am reminded that change is on its way.&nbsp; Not only is it time for a change of seasons, but it is also just about time for the changing of the guard at SMTAR.&nbsp; I was reminded of this at our General Membership Meeting at the beginning of the month.&nbsp; At this meeting, your new Officers and Directors for 2012 were elected.&nbsp; I'd like to welcome them to their leadership roles!&nbsp; Congratulations to:</p>

<p>I'd like to extend my personal thanks to Rex Brown, TAR Division 2 VP, for providing more information regarding the upcoming <a href="http://www.realtor.org/topics/membership/qa_2012dues_increase">Dues Increase</a>&nbsp;and the <a href="http://www.realtoractioncenter.com/realtors/brokers/">Broker Involvement Program</a>.&nbsp; Our next General Membership Meeting will be held October 5th in Pulaski, and it is also time to Rock Solid (Throughout the Years) at our REALTOR Celebration on November 19th.&nbsp; I hope to see you all at these upcoming events.</p>
<p>There are a couple of pretty important items of discussion on the minds of our Congressional leaders in the month ahead:&nbsp;<a href="http://www.realtoractioncenter.com/"> FHA Loan Limits &amp; the National Flood Insurance Program</a>.&nbsp; It doesn't look as though FHA Loan Limits are changing in the <a href="https://realtorparty.realtoractioncenter.com/site/Advocacy?pagename=homepage&amp;page=UserAction&amp;id=1653">SMTAR region </a>(Giles, Lawrence, Lewis, Lincoln, Marshall, Maury, Perry &amp; Wayne Counties), but they ARE dropping in areas around us, where many of us do business.&nbsp; The Flood Insurance Program is a must-have, as well, considering the constant flood issues that we face throughout our great state.&nbsp; Homeowners and homebuyers need to feel secure, and Congress has the means to do something to help.&nbsp; We have the voice that is needed to encourage Congress to take the right action, and I encourage each of you to let them know how you feel (before September 7th!)</p>
<p>Labor Day weekend is upon us!&nbsp; I hope that each of you enjoy some quality time away from your business, whether it is for an hour or a few days.&nbsp; We've all been working hard to make things work, and I think we all deserve a break!</p>

<strong>KEEPING THE REALTOR ATTITUDE IN CHECK</strong> 
<p>
<p>Want to know how people see the average REALTOR?&nbsp; Here's a simple illustration:&nbsp; go to Google.com and type "REALTORS are" in the search bar.&nbsp; You may be surprised at what pops up in the search suggestion list, and what pops up in the first set of search results.&nbsp; Here's a list of the results that we got:</p>
<ul>
<li>REALTORS are: 
<ul>
<li>scum 
<li>useless 
<li>crooks 
<li>a joke 
<li>overpaid</li></li></li></li></li></ul>
<li>And the search results: 
<ul>
<li>"ALL REALTORS SUCK......" 
<li>"Blood sucking scumbag agents...." 
<li>"Real Estate Agents vs. Used Car Salesmen...."</li></li></li></ul></li></li></ul>
<p>Well, this is not what we would hope to see.&nbsp; Words like "awesome, geniuses, superheros" should describe those who hold the key to homeownership, not "scum" and the like.&nbsp; What happened?&nbsp; How is it that the world sees you this way?&nbsp; The obvious answer is that there have been a few "bad eggs" out there making things worse for everyone else.&nbsp; While this may be the case, even the "good eggs" may be out there contributing to this opinion without even realizing it.&nbsp; Consider the age-old argument over the consumption of alcohol.&nbsp; One group of people feels that consumption of alcohol at dinner is acceptable.&nbsp; Another group of people feels that consumption of alcohol at any time is unacceptible.&nbsp; Now, put a group of REALTORS in the seat of those consuming the alcohol, and put a few members of the general public in the seat of those who are against consumption.&nbsp; What do you think would be the opinion of those members of the public as they look upon the REALTORS?&nbsp; If you let your imagination run wild with that question, you can bet that you are on the right track.&nbsp; If you can think it, someone somewhere has, as well.&nbsp; That someone, may opt not to use a REALTOR for this simple conflicting point of view,&nbsp;and they may go and tell friends of how they viewed the scene.&nbsp; As you know, stories such as this grow exponentially and often to epic proportions.</p>
<p>There is not a whole lot that you can do about how the public sees you as you go about your everyday task of living.&nbsp; In the scenario above, as in many of the scenarios you get into each day, there will be at least one person for and one person against whatever you might be doing.&nbsp; As long as this is the case, there are still people out ther for you to do business with.&nbsp; REALTORS are as diverse in attitude as are members of the general public.&nbsp; With that said, though, there ARE a few things that you could be doing in the eyes of the general public that could cause you, and the industry, more headaches.&nbsp; We are talking about what the public sees as the REALTOR ATTITUDE.&nbsp; This is not your INDIVIDUAL attitude.&nbsp; Instead, it is the attitude that the general masses anticipate from all REALTORS.&nbsp; We'd like to help you in putting your best foot forward out there with the some tips to keep your REALTOR Attitude in check:</p>
<ul>
<li>Remember that not everyone is a REALTOR and make sure that your clients know this.&nbsp; The term REALTOR is often used to describe anyone who lists and sells real estate.&nbsp; This is incorrect.&nbsp; Only members of the National Association of REALTORS can use the term "REALTOR".&nbsp; You are required to adhere to a Code of Ethics IN ADDITION to state and federal&nbsp;law.&nbsp; You have access to a wide variety of services that make you a better professional.&nbsp; You should not allow yourself to jumbled up in the public eye with those who do not have these resources. 
<li>Any time that two or more REALTORS are gathered, it could give the impression of being a "REALTOR Function".&nbsp; This could be a bona fide meeting or education session, or it could be a handful of you having lunch at a local restaurant.&nbsp; It is in these situations that you are vulnerable to scrutiny from both your peers and members of the public.&nbsp; Any discussion that you have with a group (2 or more)&nbsp;of&nbsp;REALTORS can&nbsp;give the perception that what is discussed is the general&nbsp;"REALTOR Attitude."&nbsp; 
<li>When REALTORS are gathered, whether formally or informally,&nbsp;there are several topics that should be avoided: 
<ul>
<li>Anything that might violated <a href="http://www.realtor.org/library/library/fg704">antitrus laws </a>such as discussions of price, refusals to deal 
<li>Commissions, unless actually negotiating the commission with an agent in a transaction; discussion of commissions among REALTORS can give the impression of "price fixing" 
<li>Statements or discussions about a protected class. 
<ul>
<li><a href="http://portal.hud.gov/hudportal/HUD?src=/program_offices/fair_housing_equal_opp/FHLaws">Fair Housing Law</a> protects members of the public from discrimination based on race, color, national origin, religion, sex, familial status or handicap. 
<li>Tennessee Law protects members of the public from discrimination based on race, creed, color, religion, sex, age, or national origin ~ <span style="WIDOWS: 2; TEXT-TRANSFORM: none; BACKGROUND-COLOR: rgb(255,255,255); TEXT-INDENT: 0px; LETTER-SPACING: normal; FONT: 13px Verdana, Arial, Helvetica, sans-serif; WHITE-SPACE: normal; ORPHANS: 2; COLOR: rgb(51,51,51); WORD-SPACING: 0px; -webkit-text-decorations-in-effect: none; -webkit-text-size-adjust: auto; -webkit-text-stroke-width: 0px" class="Apple-style-span">Tenn. Code Ann. § 4-21-101 &nbsp;(2011)</span> 
<li><span style="WIDOWS: 2; TEXT-TRANSFORM: none; BACKGROUND-COLOR: rgb(255,255,255); TEXT-INDENT: 0px; LETTER-SPACING: normal; FONT: 13px Verdana, Arial, Helvetica, sans-serif; WHITE-SPACE: normal; ORPHANS: 2; COLOR: rgb(51,51,51); WORD-SPACING: 0px; -webkit-text-decorations-in-effect: none; -webkit-text-size-adjust: auto; -webkit-text-stroke-width: 0px" class="Apple-style-span"></span><a href="http://www.realtor.org/mempolweb.nsf/7c7e04a0f916f203862568940053aa55/862877740df4733b86257234007985c9?OpenDocument#Duties%20to%20the%20Public">Article 10 of the REALTOR Code of Ethics </a>states that "REALTORS shall not deny equal professional services to any person for reasons of race, color, religion, sex, handicap, familial status, national origin, or sexual orientation." 
<li>IMPORTANT!&nbsp; Your E &amp; O insurance may not cover you in a lawsuit filed on the basis of discrimination!&nbsp; Many SMTAR use RICE INSURANCE.&nbsp; Discrimination is one of the categories EXCLUDED from coverage in their basic policy package.&nbsp; Their <a href="http://www.risceo.com/Tennessee/TN_2011%20DEC_POLICY_OFAC.pdf">sample policy</a>&nbsp;states that "This insurance does not apply to any claim alleging, arising from, or related to:...&nbsp; discrimination on the basis of race, color, creed, national origin, sex, religion, age, sexual preference, marital status, any mental or physical handicap or disease or any other unlawful discrimination category;"&nbsp; [Section VI. (I)]&nbsp; It is important, regardless of the company you have purchased your policy from, to check your policy for any exclusions regarding protected classes.&nbsp; In some cases, it MAY be possible to purchase an additional rider that would provide coverage in these types of lawsuits, but full coverage may not be available with some riders.</li></li></li></li></ul></li></li></li></ul>
<li>Lawsuits can arise from the simplest of infractions.&nbsp; (Anyone remember the lawsuit over the hot coffee spilled in the lap of a customer in the drive-through at a popular fast food chain?)&nbsp; The greatest price paid in any lawsuit is the "worry-time" involved in preparation for the case, especially those that involve discrimination complaints.&nbsp; This "worry-time" will take away from your regular business and could cost you clients, even if your actions are later proven to be "in the right."&nbsp; The eyes and ears of the general public are less-tolerant of actions that are construed as discriminatory, and each and every REALTOR should be aware of this.&nbsp; Additionally, some lawsuits involving real estate transactions can result in "treble-damages".&nbsp; This means, that you'd pay&nbsp;three times as much as the actual damages, and your E &amp; O policy may not cover any part of that.&nbsp; How silly would it be to find yourself in a lawsuit after a seemingly innocent discussion over lunch?</li></li></li></li></ul>
<p>We cannot control every thing we do out there.&nbsp;&nbsp;We do, however, have a duty in our profession to ensure that the integrity of our business is at the forefront of our thoughts at all times.&nbsp; Due to the amount of advertising you do, and the great number of people that you must interact with in an average transaction, it is very likely that someone is taking note of what you are up to, no matter where you are.&nbsp; Be careful out there!</p>

<strong>NEW FTC RULE THAT MAY AFFECT YOU</strong> 
<p>The Federal Trade Commission has issued the Mortgage Acts and Practices - Advertising rule that went into effect on August 19th.&nbsp; If you often provide information to your clients about a specifc lender, this may affect you.&nbsp; Principle brokers should also be aware of this policy as they will be affected if they, or any agent in their office, provides such information.&nbsp; This Rule will protect consumers from misrepresentation in the information provided, and also establishes a record-keeping requirement for those who do provide this information.&nbsp; To find out more, please visit the <a href="http://www.realtor.org/letterlw.nsf/pages/0811maprule?OpenDocument&amp;Login">NAR website.</a>&nbsp; (Please note that you will be required to log in to REALTOR.org to view this information.)</p>

<p>I hope everyone is having a great summer and that your July 4th events were a lot of fun.&nbsp; It has been business as usual, for the most part, at your REALTOR Association, but I do have a few things to let you know about this month.</p>
<p>First of all, the annual Election of Officers and Directors is coming up in Lewisburg on Wednesday, August 3rd.&nbsp;&nbsp;I hope you will come and join us for a good lunch and an update from Rex Brown, the TAR Division II Vice President.&nbsp; While you're there, you'll be able to cast your ballot for the 2012 SMTAR Officers and Directors.&nbsp; This is an important member event and a great opportunity to network with your fellow REALTORS.</p>
<p>Next, major accomplishments have been made recently in two areas that concern our profession:&nbsp; the Mortgage Assistance Relief Services (MARS) Rule and the National Flood Insurance Program (NFIP).&nbsp; Thanks to everyone out there who has taken the time to respond to <a href="http://www.realtoractioncenter.com/">NAR's Calls to Action</a> regarding these items.&nbsp; This is proof that we can make things happen if we just take action - even if it is just a small action.&nbsp; (More information about these accomplishments can be found later in this newsletter.)</p>
<p>Finally, I wanted to let everyone know that I've recently had the opportunity to meet our association's account representative from Sentrilock, Nate Winston.&nbsp;He was in the area assisting with a project that involved a small number of our members, and many of you may have met him through the techinical support line for Sentrilock.&nbsp; It was great to be able to make a direct connection with a company that is such an integral part of our business.&nbsp; He tells us that Sentrilock is working every day to improve upon the product that they currently have and to add new services that will benefit you in the future.</p>

<strong>MORE ON MARS</strong> 
<p>
<p>The Mortgage Assistance Relief Services (MARS) Rule was put in place in 2010 by the Federal Trade Commission (FTC) to combat scams against homeowners who have been faced with foreclosure due to the drastic changes in our economy.&nbsp; Those in this situation have&nbsp;a few alternatives to foreclosure available, and will seek them out in their time of need.&nbsp; It is here that scammers will attempt to steal homeowners' money by asking a fee for their service, such as a loan modification or short sale, but not actually providing that service.&nbsp; Thus, those homeowners were left out in the cold.&nbsp; The MARS Rule establishes a set of procedures&nbsp;that are intended to protect the homeowner in these cases and ensure that those who are providing the services are legitimate.&nbsp; It requires that several disclosures be made to the homeowner and establishes a specific (and somewhat cumbersome) set of record-keeping requirements.&nbsp; While this is a great thing for homeowners, and is something that is integral to their survival in this economy, the way the rule was written, REALTORS were also required to comply&nbsp;when working through a short sale transaction with their client.&nbsp; This would have been extremely difficult.</p>
<p>Blast off, NAR.&nbsp; Just this month, the FTC has opted, at the urging of NAR,&nbsp;to exclude real estate professionals from many provisions of their rule.&nbsp; Remember, they still have to protect the homeowner, so you'll still have to comply with part of the rule.&nbsp; Any agent who participates, or thinks they may participate in a short sale transaction should ensure that they are aware of the rule and what they need to do to comply with it.&nbsp;&nbsp;It is extrememly important to note that the FTC will enforce the "misrepresentation" provisions of the rule.&nbsp; Misrepresentation has always been one of the top complaints at the Tennessee Real Estate Commission, and one of the top claims filed with E &amp; O Insurance providers.&nbsp; It is no surprise that it is a top concern of the FTC in this rule.</p>
<p>To help you get an understanding of what is going on with this rule, NAR has established a set of <a href="http://www.realtor.org/letterlw.nsf/pages/marsjulyq&amp;a?OpenDocument&amp;Login">Questions and Answers</a> that should provide some clarity.&nbsp; (You will need to log in to the NAR website to access this info.)&nbsp; You may also be interested in <a href="http://www.realtor.org/topics/mars">The MARS Topic @ NAR</a>.</p>

<strong>CRAIGSLIST SCAM HITS HOME</strong> 
<p>Imagine minding your own business, making calls, preparing listing agreements and contracts - then imagine receiving a phone call from someone interested in your listing.&nbsp; Sounds great, right?&nbsp; Well, what if they are interested in your listing because they saw it for rent&nbsp;on Craigslist.com at a rock-bottom price?&nbsp; Not so good, especially if you can confirm with the seller that they did not place an ad on Craigslist, nor did they intend to rent their property out when they listed it to you.</p>
<p>We've heard of this scam.&nbsp; It's not new.&nbsp; It has happened all across the US and there have been a handful of instances of this sort of thing happening here in Tennessee.&nbsp; Now, though, it has happened right in our home territory in Columbia.&nbsp; It goes something like this:&nbsp; the "offender" or "mean, awful person" copies the images from your website or one of the many websites to which your listings are syndicated (i.e. Trulia, Zillow, REALTOR.com, etc.)&nbsp; Then, they simply create a new listing on Craigslist in the area where the property is located and wait for the calls or e-mails to start rolling in.&nbsp; They will provide interested parties with a rental application or lease agreement, and a "letter of authenticity" explaining why the property is for rent and why they are, unfortunately, out of the country and unable to meet them in person.&nbsp; Unsuspecting renters will send in a security deposit, along with their financial information on the application.&nbsp; Many times, the scam stops there and the scammer moves on to the next guy or the next scheme.&nbsp; Sometimes, though, the renter's identity may be stolen, or worse.&nbsp; In cases here in Tennessee, the renters have showed up to move in to the home only to find that someone (gasp...the homeowner!) is already living there.</p>
<p>So, how can you protect yourself and your clients from this type of fraud?&nbsp; Well, THAT is nearly impossible.&nbsp; Education and vigilance are the key.&nbsp; Don't assume that it won't happen to you.&nbsp; Maybe these tips will help:</p>
<ol>
<li>Scammers are particularly interested in empty homes and will look for images that depict a vacant property.&nbsp; Staging a home with furniture&nbsp;for your advertising photos may be a way to combat this issue. 
<li>Ensure that your web advertisings for your listings are removed in a timely manner.&nbsp; Keep in mind, however, that there are some sites that you can't control.&nbsp; Those sites that receive listing content via syndication from RealTracs may take a little time to update. 
<li>Educate your homeowners and get them involved in the process.&nbsp; Encourage your tech-savvy clients to visit Craigslist regularly to do a quick search on their listing just to be sure it's not there.&nbsp; Other sites have been used, but Craiglist is the most common.&nbsp; For those clients who are not tech-savvy but willing to learn, take a moment to show them the ropes. 
<li>Make sure that you and your sellers&nbsp;know how to handle the situation should this happen to them.&nbsp; Remember, those who are trying to rent are also victims in this scheme.&nbsp; Should they call you or show up on the property, they are not likely to be happy to learn that they have just lost money - and may not have a place to live.&nbsp; You and your sellers should attempt to remain calm and be prepared to contact the police should the situation get out of hand. 
<li>If you are assisting someone with relocating to another area, it is wise to attempt to verify that the individual on the other end of the deal is either the homeowner or authorized rental management company.&nbsp; Often, if you simply ask if that person is the legal homeowner, they'll either answer your question, dodge your question or hang up on you.&nbsp; Obviously, those who answer the question are more likely to be telling the truth. 
<li>Report any instances of this occurring with properties you list to your local authorities.&nbsp; It is fraud and could place your clients in harm's way.</li></li></li></li></li></li></ol>

<strong>FLOOD INSURANCE ROLLING ALONG</strong> 
<p>Earlier this month, the House voted to extend the National Flood Insurance Program for another 5 years.&nbsp; For anyone living in a flood zone, this is relieving news, but for those trying to sell homes in a flood zone, it's even better.&nbsp; And, yes, REALTORS were heard in this decision, as well.&nbsp; In fact, NAR was there to testify in person before the House Financial Services Committee on Insurance, Housing, and Community Opportunity.&nbsp; (Well, it was a representative of NAR, but you get the idea.)</p>
